Terms of Service

Last updated: October 10, 2026

1. About These Terms and Your Seller

This website and online store (the “Site”) is operated by NOVSIGHT LIGHTING TECHNOLOGY INC. (“NOVSIGHT,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Site and orders placed through it.

NOVSIGHT LIGHTING TECHNOLOGY INC. is the seller for an order unless a different NOVSIGHT legal entity is clearly identified as the seller before you place that order. If another legal entity is identified before you place the order, that entity is the seller for that order, and references to “we,” “us,” and “our” in provisions concerning that order mean that entity. The seller’s identity and contact details will also appear in the order confirmation or invoice. If no different seller is identified before you place the order, NOVSIGHT LIGHTING TECHNOLOGY INC. is your seller.

By placing an order, you agree to these Terms. Your use of the Site is also subject to the provisions concerning Site access and acceptable use. If you are ordering on behalf of a business, you confirm that you are authorized to bind that business.

The Site is hosted on Shopify, which provides the e-commerce platform used for the online store.

The following policies, as applicable to your order, form part of these Terms:

If a policy conflicts with these Terms on a subject specifically covered by that policy, the policy governs that subject. Product-specific or promotional terms clearly presented before you place an order also apply to that order. A more favorable written product or warranty commitment made by NOVSIGHT at the time of purchase will be honored in accordance with the applicable policy. Nothing in this paragraph reduces a right that cannot lawfully be limited.

2. Consumer Rights

Nothing in these Terms or the policies linked above excludes, restricts, or modifies any consumer right, remedy, guarantee, or warranty that cannot lawfully be excluded, restricted, or modified. If a provision conflicts with a mandatory rule of applicable consumer law, that rule prevails. Our voluntary return and express warranty policies are in addition to any such rights.

3. Eligibility and Accounts

You must be at least the age of majority in your jurisdiction to place an order. You agree to provide accurate and current information needed to process and deliver your order, including your email address, delivery address, and, where required by the carrier, a phone number.

You are responsible for keeping your account credentials confidential and for activity you authorize under your account. Please contact us promptly if you suspect unauthorized access. We may refuse or cancel an order or suspend access to an account where we reasonably believe there is fraud, abuse, unauthorized activity, or a breach of these Terms, subject to applicable law. If we cancel an order for which payment has been taken and no goods have been supplied, we will refund the amount paid for that order.

4. Products, Fitment, Availability, and Prices

Product descriptions, specifications, included items, availability, and prices are shown on the relevant product page and at checkout. The price and any shipping charges applicable to your order are those displayed before you submit it. Duties, import taxes, and customs charges are addressed in our Shipping Policy. We may change prices or product information for future orders, but a later change does not alter an order already accepted.

We may correct an obvious pricing or listing error before dispatch. If we cancel an affected order after taking payment, we will give you a full refund. If a material product detail changes after you order but before dispatch, we will notify you and offer an appropriate choice, including cancellation and a refund where required by applicable law.

Fitment. Before ordering, please check the product-specific fitment information against your vehicle’s year, make, model, trim, factory lighting configuration, and modifications. Fitment guides are intended to assist selection and may not cover every vehicle variation. If you are unsure, contact us before ordering. This section does not reduce any remedy available if a product does not conform to its description or to applicable consumer law.

5. Product Safety, Installation, and Road Use

Permitted installation and use may differ by product and by location. Review the applicable product information, markings, and installation instructions, and check the rules that apply where the product will be installed and used, including rules for use on public roads. A product’s fitment for a vehicle does not by itself establish that every use of that product is lawful in every location.

Products should be installed, wired, fused, and adjusted in accordance with their instructions by a person competent to perform that work. Incorrect installation, modification, or use may damage the product or vehicle or create a safety risk. To the extent a loss is caused by incorrect installation, modification, or unlawful use rather than a defect in our product or our own conduct, we are not responsible for that loss, subject to applicable law.

Nothing in this section reduces our obligations concerning product safety, accurate product descriptions, defective products, or liability that cannot lawfully be limited.

6. Orders, Payment, and Cancellation

Submitting an order is an offer to buy. An order acknowledgment confirms that we received your order; it does not itself mean that we accepted it. Unless applicable law requires otherwise, a contract for the ordered goods is formed when we confirm dispatch. We may decline or cancel an order before dispatch, including where an item is unavailable, a price or listing contains an obvious error, or we reasonably suspect fraud. If payment has been taken for an order we cancel, we will refund it.

Payment must be authorized before dispatch unless we agree otherwise. Available methods and processing information are described in our Payment Method policy.

You may request cancellation before the carrier actually accepts the parcel. Creating a shipping label alone is not carrier acceptance. After carrier acceptance, our Returns & Exchanges policy applies. This cutoff does not remove any cancellation, withdrawal, or other right that applicable law gives you after dispatch.

7. Delivery, Risk, Title, and Failed Delivery

Shipping methods, charges, processing information, and delivery estimates are described in our Shipping Policy and Shipping Fee page. Delivery estimates are not guarantees, but we will comply with any delivery obligations imposed by applicable law. If we cannot dispatch within a time required by law or promised to you, we will provide the notice, cancellation option, and refund required by applicable law.

Risk of loss or damage passes to you when the goods are delivered to you or to a person you nominate to receive them, unless applicable law provides a different rule. Ownership of the goods passes when we have received payment in full, subject to applicable law.

If delivery fails because of an inaccurate or incomplete address, refusal to accept delivery, failure to collect the parcel, or refusal to pay lawfully due duties or taxes, the order may be handled under our Returns & Exchanges and Shipping Policy. Actual costs directly caused by the failed delivery may be deducted from a refund only as described in those policies and to the extent permitted by applicable law.

8. Returns, Refunds, Exchanges, and Warranty

Our voluntary return and exchange arrangements, including eligibility, request steps, shipping costs, and any applicable product-specific exceptions, are described in our Returns & Exchanges policy. The separate Warranty Policy describes our express product warranty, including applicable periods, registration extensions, proof of purchase, gift orders, and purchase-channel rules.

Our express warranty is in addition to any rights you have under applicable consumer law. A voluntary return deadline, warranty period, registration condition, or “Final Sale” designation does not remove any statutory remedy that cannot lawfully be excluded. We may request information reasonably needed to verify an order or assess a claim, as described in the applicable policy.

9. Intellectual Property

Content on the Site, including text, images, videos, graphics, product descriptions, layouts, and software, is owned by NOVSIGHT or used with permission and is protected by applicable intellectual property laws. You may view and print Site pages for personal, non-commercial use, provided you do not remove proprietary notices. Other reproduction, distribution, publication, or commercial use requires our prior written permission unless applicable law permits it.

Our trademarks and our references to third-party vehicle brands are addressed in our Intellectual Property Rights and Trademark Notice pages. References to third-party brands do not imply sponsorship or endorsement unless expressly stated.

10. Reviews and Other User Content

If you submit a review, photograph, video, comment, or other content to the Site, you confirm that you have the rights needed to submit it and that it is not unlawful, misleading, defamatory, or infringing. You remain responsible for content you submit.

You grant the applicable NOVSIGHT seller and the operator of the Site a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use that content to operate the Site and promote NOVSIGHT products and business. We may allow service providers acting for us to do the same for those purposes. This license does not transfer ownership of your content to us.

If your content includes personal information, our Privacy Policy and applicable data protection law govern its processing. You may request removal of content by emailing service@novsight.com. We will review and act on reasonable requests, subject to applicable law and any continuing need to retain records. We may remove content that breaches these Terms or applicable law.

11. Acceptable Use

You agree not to use the Site to: (a) engage in unlawful conduct; (b) infringe another person’s rights; (c) submit false or misleading information; (d) transmit malicious code; (e) collect another person’s personal information without authorization; (f) scrape or disrupt the Site in a way that breaches applicable law or interferes with its operation; (g) bypass Site security; or (h) misrepresent counterfeit or unauthorized products as genuine NOVSIGHT products. We may restrict access for a material breach of this section, subject to applicable law.

12. Third-Party Services and Links

The Site may link to third-party websites or use third-party services, including payment, review, analytics, and delivery services. Those providers may have their own terms and privacy notices. We do not control third-party websites. This section does not reduce any responsibility we have for services used to perform our obligations to you or any right you have under applicable law.

13. Site Availability and Changes

We may update, maintain, suspend, or discontinue features of the Site. We do not guarantee that the Site will always be available or free from errors. Changes to the Site do not change our obligations under an order already accepted or any right that cannot lawfully be limited.

14. Site Content and Warranties

To the extent permitted by applicable law, the Site and general Site content are provided on an “as available” basis. Product descriptions, any express warranty we provide, and statutory rights remain subject to the specific rules stated elsewhere in these Terms and the applicable policies. Nothing in this section disclaims an implied warranty on goods where doing so is prohibited by law.

15. Limitation of Liability

Subject to section 16 and to the maximum extent permitted by applicable law, our total liability arising from a particular order or product will not exceed the amount you paid us for the product giving rise to the claim. To the same extent, we are not liable for indirect, incidental, special, punitive, or consequential losses, including lost profits or revenue.

We are not responsible for loss or damage to a vehicle or its systems to the extent caused by incorrect installation, wiring, modification, or use, rather than a defect in our product or our own conduct. This section does not limit any remedy or compensation that applicable consumer or product liability law makes non-excludable.

16. Liability That Cannot Be Limited

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; a statutory guarantee, warranty, or remedy that cannot lawfully be excluded or limited; or any other liability that applicable law does not permit us to exclude or limit.

17. Your Responsibility for Misuse

To the extent permitted by applicable law, you agree to reimburse us for reasonable losses and costs arising directly from your unlawful use of the Site, your intentional or material breach of these Terms, or content you submit that infringes a third party’s rights. This does not apply to the extent a loss is caused by our negligence, breach of these Terms, or breach of applicable law, and it does not reduce a consumer right that cannot lawfully be limited.

18. Events Beyond Reasonable Control

We are not responsible for a delay or failure to perform to the extent caused by an event beyond our reasonable control, such as a natural disaster, war, civil unrest, epidemic, carrier or port disruption, customs action, government action, or failure of utilities or communications networks. We will take reasonable steps to reduce the effect of the event and will provide any notice, cancellation option, or refund required by applicable law.

19. Governing Law

Unless mandatory applicable law requires otherwise, these Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. This choice does not deprive a consumer of mandatory protections that apply in the place where the consumer resides or of any court access that cannot lawfully be restricted.

20. Resolving Concerns

If you have a concern about an order or the Site, please contact us at service@novsight.com with a description of the issue and your preferred resolution. We will make a reasonable effort to respond and resolve the matter directly. You may also use any court, regulator, or other dispute-resolution process available to you under applicable law. These Terms do not require binding arbitration or waive your right to participate in a class or representative proceeding.

21. Changes to These Terms

We may update these Terms for future use of the Site and future orders. We will post the revised version with an updated date and give any additional notice required by applicable law. Changes do not apply retroactively to orders already placed and do not reduce rights that arose under the Terms or policies applicable when an order was placed. Your continued use of the Site or placing a further order after the revised Terms are posted constitutes your acceptance of the revised Terms for that use or order.

22. General

If a provision of these Terms is found unenforceable, the remaining provisions remain effective to the extent permitted by law. These Terms, the policies incorporated above, and any applicable product-specific or promotional terms clearly disclosed before an order together form the agreement concerning that order and use of the Site. Our failure to enforce a provision is not a waiver of it.

We may transfer our rights and obligations under these Terms if doing so does not materially reduce your rights or remedies. You may transfer yours with our written consent or where applicable law permits. Nothing in these Terms creates a partnership, agency, or employment relationship between you and us.

23. Contact
